Double Cream is an independent distributor and is not associated with such trademark owners or the manufacturers of the watches sold on this website. Use of manufacturer’s names, logos, and identifying marks is for “fair use” in selling merchandise manufactured by these name brands and does not imply a business relationship between Double Cream and the manufacturers.

INTRODUCTION AND GOVERNING LAW

These are the Terms & Conditions of Sale applicable to on-line purchases from Double Cream.
These terms and the State and Federal laws of Victoria, Australia and The Commowealth of Australia apply to all transactions for the purchase of products from Double Cream, its web site at www.doublecream.com.au and any associated web page (the "Site"). These terms represent the complete Agreement between Double Cream and the Buyer covering the sale of Products from this Site. Except for terms implied by applicable legislation, Double Cream does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Buyer's completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by Double Cream.


PRICES

The prices to be paid by the Buyer for all Products will be Double Cream's current selling price on the date of receipt by Double Cream of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Delivery Charges page of the Checkout.

Double Cream will not be responsible for errors in pricing that appear on the Site. Double Cream will notify a Buyer in the event of a pricing error on the Site before an Order is delivered and the Buyer will have the opportunity to cancel its Order within a reasonable time. Double Cream reserves the right to cancel unilaterally any Order based on a mistake in pricing within a reasonable time of receiving that Order.

Double Cream reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website include Australian Goods and Services Tax (GST) at 10%.

The GST payable by the Buyer will be shown on the invoice, which Double Cream will send to the Buyer. Delivery charges to the nominated address will be advised to the Buyer on the delivery screen and Order confirmation pages of the Site.


STOCK AVAILABILITY

If a Product is out of stock when Double Cream processes an Order, Double Cream will contact the Buyer to discuss revised delivery times or refund options.


ORDER DELIVERY AND CANCELLATION

All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):

(a) Quantity and description of Products;
(b) The full street address to which the Product is to be delivered;
(c) Current billing address to which credit card statements are sent.

The Buyer must complete all information requested on the Order form before the Order is processed by Double Cream.
Double Cream will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If Double Cream does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.


DELIVERY

Delivery times quoted in the Site are indicative only. Double Cream will endeavor to deliver your order within the specified time. The Buyer acknowledges that Double Cream may, from time to time, be subject to production, delivery or other unforeseen delays and that Double Cream may allocate distribution of Products ordered among its customers at its sole discretion.

If Buyer's Order has not been delivered within a reasonable time, the Buyer should contact Double Cream at: info@doublecream.com.au. If no-one is available at the delivery address to receive the Products, Double Cream's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. Double Cream reserves the right to make partial delivery of an Order where multiple products have been ordered.


PAYMENT

Credit card payment for Products purchased from Double Cream via the Site can be made only by VISA or MasterCard credit cards.

Double Cream will verify the credit card information submitted by the Buyer and will advise the Buyer that its Order has been accepted. The Buyer agrees to submit to Double Cream such information as may be reasonably requested by Double Cream for the authorization and verification of its credit card purchases.

Double Cream reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider. In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, Double Cream at its discretion may delay or cancel delivery of Orders placed by the Buyer.

Double Cream may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to Double Cream. If the Buyer's account is placed in collection, Double Cream will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.


CANCELLING AN ORDER PRIOR TO SHIPMENT

If the Buyer wishes to cancel an Order prior to shipment, the Buyer must contact Double Cream Customer Service immediately via e-mail at info@doublecream.com.au. Double Cream will endeavour to accommodate the Buyer's request if the merchandise has not shipped. If the Buyer's entire order is cancelled prior to shipment Double Cream will apply a credit to the Buyer's credit card and may also apply a cancellation fee. If an Order has already shipped, Double Cream's normal returns and exchanges procedure will apply (see below).


FREIGHT METHODS

Double Cream will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer must not arrange its own courier to collect the Products from Double Cream.


PRODUCTS DAMAGED IN TRANSIT

Claims for alleged damage to Products caused in transit from Double Cream to the destination specified by the Buyer must be notified to Double Cream as stated below within 24 hours of receipt of delivery and the consignment note must be marked as "Received Damaged".

The Buyer must contact Double Cream by e-mail to info@doublecream.com.au and obtain return instructions. The Buyer must also supply a copy of the consignment note to Double Cream. Double Cream will contact the Buyer to arrange a suitable remedy.

RETURNS AND EXCHANGES

The Buyer may return a Product they have ordered in exchange for another item we sell or for a store credit. The Product must be returned to the address specified by Double Cream unused and within a reasonable timeframe along with all its packaging and papers. A $15 fee does apply to returns and exchanges in order to help Double Cream to cover the extra shipping cost. In the case that the Buyer would like to exchange their purchase for another Product, Double Cream will refund or debit your credit card for the difference in price between the two Products (less the $15 fee). In the case that the Buyer would like a store credit, Double Cream will provide the Buyer via email with a unique discount coupon code for the value of the original purchase (less the $15 fee) which may be entered at the checkout screen at the time of placing a subsequent order.


DELIVERY OUTSIDE AUSTRALIA AND NEW ZEALAND

Except in particular instances negotiated prior to placing an order, Double Cream is unable to deliver to addresses outside Australia and New Zealand.


AMENDMENT OF TERMS AND CONDITIONS

Double Cream may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.

All products are accompanied by their respective terms and conditions, and are also covered by their specific manufacturer's warranty directly by Double Cream. Please refer to the manufacturer's website for the specific warranty conditions.
